Code of Ethics

 

RESPONSIBILITY

(A) The Marie Detty Youth & Family Services staff value objectivity and integrity, and in providing services, strive to maintain the highest standards of their profession.  It is the mission of Marie Detty to provide a continuum of care for the children, youth and families of Southwest Oklahoma.  Early childhood education, prevention, diversion, protective and treatment services establish the cornerstone of intervention.  Additionally, we will advocate on behalf of children, youth and families and on issues impacting our communities.

(B) Marie Detty Youth & Family Services staff remain accountable to the standards of their individual profession and follow ethical protocols.

(C) Marie Detty Youth & Family Services staff recognize their primary obligation to help others acquire knowledge and skill.  They maintain high standards of scholarship and objectivity by presenting information fully and accurately.

(D) Marie Detty Youth & Family Services staff know they bear a heavy social responsibility because their recommendations and professional actions may alter the lives of others.  They are alert to personal, social, organizational, financial or political situations or pressures that might lead to misuse of their influence.

(E) Marie Detty Youth & Family Services staff will provide adequate and timely evaluations to employees, trainees, students and others whose work they supervise.

(F) Marie Detty Youth & Family Services staff will involve the client in all aspects of services.  Client participation is necessary to determine client’s abilities, aptitudes, skills, and interests.

(G) Marie Detty Youth & Family Services will cooperate with any monitoring activities including, but not limited to, financial audits, governmental and contractual monitoring services, licensure monitors, accreditation monitors, etc.

(H) Marie Detty Youth & Family Services will strive to satisfy the clients, the community, and the families through an extensive quality improvement program.

(I) Marie Detty Youth & Family Services staff will not participate in, condone, or be associated with dishonesty, waste, fraud, deceit, abuse, and other wrong doing or misrepresentation that alters or impacts the actual or factual situation.

(J) Marie Detty Youth & Family Services staff will not exploit through a dual relationship with clients and staff for personal advantage, profit, satisfaction or interest.

(K) Marie Detty Youth & Family Services staff will make efforts to ensure that all clients are made aware of other resources and services not available within the Marie Detty Youth & Family Services system.

(L) Marie Detty Youth & Family Services use of social media will not violate the confidentiality or ethical policies of the person served or the agency.

 

HUMAN RESOURCES and COMPETENCE

(A) Marie Detty Youth & Family Services staff will recognize the boundaries of their competence and the limitations of their techniques and only provide services, use techniques or offer opinions as professionals that meet recognized standards.  The Clinical Director shall approve all therapeutic techniques.

(B) Marie Detty Youth & Family Services staff will maintain knowledge of current scientific and professional information related to the services they render.

(C) Marie Detty Youth & Family Services staff will accurately represent their competence, education, training and experience.  This may include listing one or a combination of the following (whichever is appropriate): (1) their highest relevant degree; (2) licensure, certification, or registration title and / or (3) any administrative title i.e., Coordinator.

(D) Marie Detty Youth & Family Services staff shall have all credentials approved by the Executive Director and immediate supervisor.

(E) Marie Detty Youth & Family Services staff who have the responsibility for decisions involving individuals or policies based on test results must have adequate training in test measurement, validation problems and other test research relevant to the appropriate profession.  The adequacy of the training will be determined by their respective clinical supervisor.  This may be the Coordinator, Area Consultant, or Division Director.

(F) Marie Detty Youth & Family Services staff will refrain from involving themselves in a personal relationship with a client or coworker, their situation, or any other circumstance that may compromise the ability of the staff to effectively fulfill the purpose of their position. They will refrain from undertaking any activity in which their personal issues are likely to result in inadequate professional services or harm to a client.  When they become aware of their personal issues or extreme feelings, they will seek competent professional consultation and notify their immediate supervisor to determine whether they should suspend, terminate or limit the scope of their professional relationship.

 

MORAL AND LEGAL STANDARDS

(A) Moral, ethical and legal standards of behavior are a personal matter to the same degree as they are for any other citizen, except as these may compromise the accomplishment of their professional responsibilities.

(B) Marie Detty Youth & Family Services staff should be aware of the prevailing community standards and of the possible impact upon the quality of professional services provided by their conformity to, or deviation from, these standards.

(C) Marie Detty Youth & Family Services staff will not condone practices that violate civil rights or result in illegal actions, or promote discrimination of employees, clients or of the general public.

(D) In providing services, Marie Detty Youth & Family Services staff must avoid any action that violates or diminishes the legal and civil rights of clients or of others who may be affected by their actions.

(E) Marie Detty Youth & Family Services staff will understand and conform to relevant federal, state, local and agency regulations regarding standards and conduct of their practice.

(F) Marie Detty Youth & Family Services staff will ensure personal preferences, problems, or beliefs will not interfere with their ability to provide quality services.

 

PUBLIC RELATIONS including MEDIA and MARKETING

(A) Public statements, announcements of services, and promotional activities must provide sufficient information to aid the consumer public and indicate Marie Detty sponsorship.

(B) Marie Detty Youth & Family Services staff will represent accurately and objectively their professional qualifications, affiliations, and functions, as well as those of the agency with which they are associated.

(C) Marie Detty Youth & Family Services staff will distinguish between public statements made as a private citizen and those made as a representative of the agency.  They need to be aware however, that any statement they make may be interpreted as being representative of the agency.

(D) Marie Detty Youth & Family Services staff, in presenting educational programs to the public, will make every effort to present accurate, relevant and current information.

(E) Marie Detty Youth & Family Services staff will avoid becoming involved in the provisions of direct therapy to individuals within the setting of educational groups.

(F) Marie Detty Youth & Family Services staff will take action through appropriate channels against unprofessional conduct by either Marie Detty Youth & Family Services staff or other professionals in the community.

 

CONFIDENTIALITY

(A) Marie Detty Youth & Family Services staff will inform clients fully about the limits of confidentiality in a given situation, the purpose for which information is obtained, and how it may be used.  The use of Informed Consent forms is mandatory.

(B) Clinical records or case examples used in teaching research and writing may be used only when appropriate signed consent forms are obtained.

(C) All statistics collected on clients shall be disguised to protect client identity and conform to Oklahoma State Health Department procedures.

(D) Marie Detty Youth & Family Services staff will maintain written files of client records.  These records will be stored in locked filing cabinets and locked rooms.  Electronic records shall be safeguarded through password protection and back-up files will be secured in locked cabinets.

(E) Marie Detty Youth & Family Services staff will take appropriate means to safeguard the disposition of old client records.

 

CONSUMER PROTECTION

(A) Marie Detty Youth & Family Services staff members must clarify their responsibilities and keep all parties informed of their commitments when there is a conflict of interest between a client and an institution utilizing Marie Detty Youth & Family Services staff.

(B) Marie Detty Youth & Family Services staff will fully inform consumers as to the purpose and nature of an evaluative, treatment, educational or training procedure.

(C) Marie Detty Youth & Family Services staff will make every effort to avoid dual relationships with clients or coworkers because of the inherent risk of impairment of professional judgement and increased risk of client exploitation.  Examples of such dual relationships include:

1. Providing diagnostic and treatment services to supervisors, close friends or relatives, or to Marie Detty Youth & Family Services employees, their close friends or relatives

2. Sexual intimacies with clients

3. Financial ventures including the exchange of goods or services or finances

4. Personal relationship as defined by HUMAN RESOURCES and COMPETENCE, SECTION (F)

Where a duality of roles arises with a current or former client of the center, appropriate consultation and supervision must be sought.  In all cases, the coordinator must be informed.

(D) Marie Detty Youth & Family Services must not offer clinical services by auxiliary staff i.e., interns, practicum students and volunteers, unless appropriate supervision is provided and full responsibility is assumed by the Clinical Supervisor.

(E) No commission, rebate or other form of remuneration may be given or received for referral of clients for professional services whether by an individual or by an agency.

(F) Marie Detty Youth & Family Services staff will terminate a clinical or consulting relationship when it is reasonably clear that the consumer is not benefiting from it.

 

PROFESSIONAL RELATIONSHIPS

(A) Marie Detty Youth & Family Services staff endeavoring to work in a multi-disciplinary team setting will make full use of all the professional, technical and administrative resources that best service the interests of consumers.

(B) Marie Detty Youth & Family Services staff will take into account the traditions and practices of other professional agencies and work cooperatively with members of such groups.

(C) Marie Detty Youth Services staff who supervise other professionals or professionals in training, accept the obligation to facilitate their further professional development by providing suitable working conditions, consultation and experience opportunities.

(D) When acting as a supervisor, trainer, or researcher, Marie Detty Youth & Family Services staff will provide to their subordinates informed choice, confidentiality, due process and protection from physical and mental harm or harassment including dual relationships.

(E) Marie Detty Youth & Family Services staff will support the integrity, reputation and proprietary rights of any other organization utilizing Marie Detty Youth & Family Services staff.  When it is judged necessary in a client’s interest to question an organization’s programs or policies, Marie Detty Youth & Family Services staff will attempt to effect change by constructive action within the organization.

 

VIOLATIONS OF CODE OF ETHICS

Violations of the written code of ethics are handled in the following manner:

- Staff members, persons served, and concerned individuals may file a written notice or present a verbal notice with the Executive Director or his or her designee

- The notice is reviewed by the Executive Director or his/her designee within seven working days, with a written formal notification of the outcome of the review sent to the reporting party

- The notice and formal notification is dated and filed

- An employee found in violation of the agency ethics policy is subject to disciplinary action or termination.  Actions are approved by the Executive Director to ensure action is fair and consistent

 

 A "no reprisal" system is in place to protect those who report violations.

PRACTICE OF ETHICAL BEHAVIOR and PROFESSIONAL RESPONSIBILITIES

Marie Detty Youth & Family Services employees are expected to act ethically in the areas of business practices, marketing, service delivery, professional responsibilities, and human resources.  Unethical actions, or the appearance of unethical actions, are unacceptable under any conditions. The policies and reputation of Marie Detty Youth & Family Services depend to a very large extent on the following considerations.

 

Each employee must apply her/his own sense of personal ethics, which should extend beyond compliance with applicable laws and regulations in business situations, to govern behavior where no existing regulation provides a guideline. It is each employee's responsibility to apply common sense in business decisions where specific rules do not provide all the answers.

 

In determining compliance with this standard in specific situations, employees should ask themselves the following questions:

1. Is my action legal?

2. Is my action ethical?

3. Does my action comply with Marie Detty Youth & Family Services policy?

4. Am I sure my action does not appear inappropriate?

5. Am I sure that I would not be embarrassed or compromised if my action became known with the Organization or publicly?

6. Am I sure that my action meets my personal code of ethics and behavior?

7. Would I feel comfortable defending my actions on the 6 o’clock news?

 

Each employee should be able to answer "yes" to all of these questions before taking action.

 

Each director, manager and supervisor is responsible for the ethical business behavior of her/his subordinates. Directors, managers and supervisors must weigh carefully all courses of action suggested in ethical as well as economic terms, and base their final decisions on the guidelines provided by this policy as well as their personal sense of right and wrong.

CONFLICTS OF INTEREST

In addition, no employee, officer, or agent of Marie Detty Youth & Family Services shall participate in the selection, award, or administration of a contract involving Marie Detty Youth & Family Services if a real or apparent conflict of interest would be involved. Such a conflict would arise when the employee, officer, or agent, or any member of her or his immediate family, his or her partner, or an organization that employs or is about to employ any of the parties indicated herein, has a financial or other interest in referral sources, funding sources, regulatory agencies, clients or families.

 

GIFTS, MONEY, AND GRATUITIES

Other than modest gifts given or received in the normal course of business (including travel or entertainment), neither you nor your relatives may give gifts to, or receive gifts from, the Agency's customers or vendors. This is especially relevant to accepting or making client referrals. Other gifts may be given or accepted only with prior approval of your supervisor or the Agency's management and in no event should you put the Company or yourself in a position that would be embarrassing if information about the gift was made public.

 

When dealing with public officials, employees and directors must avoid any activity that is or appears illegal or unethical. Many federal, state and local governmental bodies strictly prohibit the receipt of any gratuities by their employees, including meals, transportation, lodging and entertainment. You must be aware of and strictly follow these prohibitions.

 

Any employee or director who pays or receives bribes or kickbacks will be immediately terminated and reported as warranted, to the appropriate authorities. A kickback or bribe includes any item intended to improperly obtain favorable treatment, including a bribe to guarantee that the Agency will use the services of a particular vendor when such use is not advantageous to the Agency.

PERSONAL FUND RAISING

Marie Detty Youth & Family Services does not tolerate personal fund raising by employees, officers, or agents.  This includes personnel soliciting funds on behalf of a personal cause, having clients selling items on behalf of the Agency, and allowing clients to raise funds by appeals to personnel or other clients.  Examples include but are not limited to selling cookies for a daughter in girl scouts and selling candy or wrapping paper for a child’s school.

 

PERSONAL PROPERTY

All Marie Detty Youth & Family Services officers, employees, or agents shall show respect for and safeguarding of the personal property of clients, visitors, and personnel including property owned by Marie Detty Youth & Family Services.

 

BOUNDARIES

Marie Detty Youth & Family Services officers, employees, or agents shall not exploit their professional relationships with clients (or former clients), supervised students or employees, sexually or otherwise for personal or business advantage.   It is considered unethical for a supervisor to date or attempt to date an employee in his or her area of supervision.

 

WITNESSING OF LEGAL DOCUMENTS

Marie Detty Youth & Family Services officers, employees, or agents shall not act as witness on legal documents for clients including but not limited to the client’s personal power of attorney, guardianship, and advanced directives.  This does not include Marie Detty Youth & Family Services documents.

COMPLIANCE WITH LAWS, REGULATIONS AND ORGANIZATION POLICIES

Marie Detty Youth & Family Services does not tolerate the willful violation or circumvention of any Federal, state, or local law by an employee during the course of that person's employment; nor does the Organization tolerate the disregard or circumvention of Marie Detty Youth & Family Services Center policy or engagement in unscrupulous dealings.
